Alternative Dispute Resolution ("ADR") refers to any means of settling disputes outside of the courtroom. Alternative Dispute Resolution typically includes arbitration, mediation and/or counseling. Due to rising costs of litigation, and courthouse time delays more states have begun experimenting with Alternative Dispute Resolution programs. Some of these programs are voluntary; others are mandatory.

Arbitration is a simplified version of a trial usually involving no or limited discovery, and simplified rules of evidence.
